1. Acceptance of Terms

By creating an account and using The CheatGold platform ("the Platform"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree, you must not use the Platform.

2. Platform Description

The CheatGold is a consolidated, institutional-grade market intelligence platform that aggregates and displays data from the XAUUSD (Gold) market. The Platform provides technical analysis, order flow data, and market structure insights. It is a reference tool designed to assist users in their own market research.

The information, indicators, signals, and data provided are for informational and educational purposes only. They do not constitute, and should not be construed as, financial, investment, or trading advice.

ANY DECISION TO TRADE OR INVEST IN FINANCIAL MARKETS, INCLUDING BUT NOT LIMITED TO XAUUSD, IS SOLELY THE RESPONSIBILITY OF THE USER.

You acknowledge that TRADING INVOLVES SIGNIFICANT FINANCIAL RISK, including the possibility of loss of principal. Past performance does not guarantee future results.

YOU ARE SOLELY RESPONSIBLE FOR ALL TRADING DECISIONS MADE USING INFORMATION OBTAINED FROM THE PLATFORM.

4. User Accounts & Responsibilities

You must provide accurate and complete information when creating an account.
You are responsible for maintaining the confidentiality of your login credentials.
You are responsible for all activities that occur under your account.
You must notify us immediately of any unauthorized use of your account.

5. Subscriptions & Payments

The Platform offers both free trials and paid subscription plans ("Pro" and "Premium").
Payment for subscriptions is processed through third-party providers (e.g., GCash, BDO, BPI, GoTyme).
All fees are non-refundable unless otherwise required by law.
We reserve the right to change pricing or subscription terms with reasonable notice.

6. Intellectual Property

All content, code, algorithms, and designs on the Platform are the intellectual property of CheatGold.
You may not copy, distribute, or reverse-engineer any part of the Platform without explicit permission.

7. Data Privacy & Consent

By using the Platform, you consent to:

The collection and storage of your personal data (email, phone number, trading preferences) for account management and service improvement.
The receipt of administrative emails (e.g., password resets, payment confirmations).
Optional: The receipt of marketing communications, promotional offers, and educational materials, as indicated by your consent during signup.

You may opt out of marketing communications at any time.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CHEATGOLD SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

(i) YOUR USE OR INABILITY TO USE THE PLATFORM;
(ii) ANY TRADING DECISIONS MADE BASED ON INFORMATION PROVIDED BY THE PLATFORM;
(iii) UNAUTHORIZED ACCESS TO OR USE OF OUR SERVERS AND/OR ANY PERSONAL INFORMATION STORED THEREIN.

9. No Warranty

THE PLATFORM IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

10. Termination

We reserve the right to suspend or terminate your account at our sole discretion, without notice, for any violation of these Terms.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of the Philippines.

12. Changes to Terms

We may update these Terms from time to time. We will notify you of any material changes. Your continued use of the Platform constitutes acceptance of the revised Terms.
